JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 02-09-2022 This writ application has been filed seeking proper investigation of the case being Supaul P.S. Case No. 6 of 2016 dated 03.01.2016 registered for the offences under Sections 436, 326, 307, 34 of the Indian Penal Code and later on Section 302 IPC was also added.

Neither learned counsel for the petitioner nor learned counsel for the State is able to say as to what is the present stage of the case.

Paragraph '17' of the counter affidavit though states that investigation is being carried out in a full-proof manner and the case

Patna High Court CR. WJC No.125 of 2017(3) dt.02-09-2022 2/2 has been supervised by the S.D.P.O., Supaul and the S.P. has issued Report 02, it is not known as whether the directions issued by the S.P. to the I.O. has been carried out and the investigation is complete. In the facts and circumstances, this Court directs the Superintendent of Police, Supaul to look into this matter, review the case and in case it is found that the investigation is still pending, he will ensure that the investigation be completed within a period of four months from the date of communication of this order and appropriate report in accordance with law be submitted in the learned court below. If it is found that the I.O. has not been working on this case, he may change him immediately.

In case the investigation has already been completed and a report has been submitted in the learned court below, it will be open for the petitioner to seek his remedy, if so advised, in accordance with law.
