JUSTICE RAJIV ROY ORAL ORDER 10-01-2023 Heard Mr. Ajay Mukherjee, learned counsel for the petitioner and Mr. Bharat Bhushan, learned APP for the State. The petitioner apprehends his arrest in connection with Belhar P.S. Case No. 200 of 2021 for the offence registered under Sections 448, 354, 504 and 506 of the Indian Penal Code. As per the prosecution story, the lady has alleged that the petitioner broke open the door and tried to assault her. Learned counsel for the petitioner submits that they are agnates and there are land dispute between the parties. Further, there is a vague allegation of assault although there is no injury on the part of the informant.

Learned APP for the State, on the other hand, opposes the prayer for anticipatory bail stating that the petitioner barged into the house of the informant.

No.50559 of 2022(2) dt.10-01-2023 2/2 Taking into account the kind of accusations as also the fact that he will be cooperating in course of investigation, this Court is inclined to grant him privilege of anticipatory bail. Let the petitioner in the event of arrest or surrender within a period of four weeks from the date of receipt of the order, shall be released on anticipatory bail on furnishing bail of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate/Court concerned, Banka in connection with Belhar P.S. Case No. 200 of 2021 subject to condition as laid down under Section 438(2) of the Cr.P.C.
