Petitioner, already in custody, seeks bail in connection with Chapra Muffasil PS Case No.174 of 2017, registered under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been implicated in this case only on the basis that one of the co-accused Azad Alam was taking name of the petitioner while escaping away but the petitioner was not put on TIP and he is in custody since 22.07.2017 and Azad Alam has been granted bail by this Court vide Cr. Misc. No.12292 of 2018 on 18.04.2018.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.29454 of 2018(2) dt.11-05-2018 2/2 circumstances, petitioner Rakesh Baitha @ Rakeshwa @ Dhobiya @ Rakeshwar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Chapra, District Saran in connection with Chapra Muffasil PS Case No.174 of 2017.
