Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Bettiah Town P.S. Case No. 736 of 2020, registered for the offences punishable under Sections 406, 420 of the Indian Penal Code and 138 of the NI Act.

It has been jointly submitted that Rs. 1,50,000/- has been returned by the petitioner to the informant. The learned counsel for the petitioner has submitted that the rest amount will be paid by the petitioner to the

Patna High Court CR. MISC. No.60002 of 2021(9) dt.12-01-2023 2/2 informant. He has assured that the petitioner shall pay rest amount of Rs. 70,000/- to the informant at the time of furnishing his bail bond.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah in connection with Bettiah Town P.S. Case No. 736 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

With further condition that petitioner shall make a payment of Rs. 70,000/- to the informant, at the time of furnishing of his bail bond.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
