Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
This application for anticipatory bail arises out of Kudra P.S. Case No. 297 of 2020 (G.R. No.1810 of 2020) for the offence punishable under Sections 341, 323, 324, 307, 379/34 of the Indian Penal Code.
At the very outset, learned counsel for the petitioners seeks permission to withdraw this bail application on behalf of petitioner no.3, above named.
Patna High Court CR. MISC. No.6775 of 2021(3) dt.01-12-2021 2/2 Accordingly, this bail application is dismissed as withdrawn as against petitioner no.3, above named. It has been submitted by learned counsel for the petitioners that the petitioner nos, 1, 2 and 4 are said to have assaulted the prosecution side and there is previous enmity between the parties, inasmuch as, there is case and counter case from both the sides.
Considering the aforesaid facts, this Court is inclined to grant anticipatory bail to the petitioner nos. 1, 2 and 4.
Let the petitioner nos.1, 2 and 4, above named, in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. - VI, Kaimur at Bhabua, in connection with Kudra P.S. Case No. 297 of 2020 (G.R. No.1810 of 2020), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
