JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2015 Heard learned counsels for the petitioner and the State. The petitioner being the maternal aunt of the husband of the victim is apprehending arrest in a case initially registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code, subsequently Sections 364/34 of the IPC were added.
It is alleged that the marriage of the daughter of the informant was performed three years prior to the occurrence when the daughter of the informant was killed for non-fulfilment of the dowry demand and dead body of the victim was made to disappear.
It is submitted by learned counsel for the petitioner that the petitioner is not the family member of the husband of the
Patna High Court Cr.Misc. No.5234 of 2015 (2) dt.09-02-2015 2/2 victim and the investigation suggests that it has not been ascertained by the police till date whether the victim is dead or alive.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur in connection with Hathauri P.S. Case No. 48 of 2010, subject to the conditions as laid down under Section 438(2) Cr.P.C.
