JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 364/34 of the Indian Penal Code.
It is alleged that the petitioner abducted the informant and tied his hands and when on the toll plaza, the informant raised alarm then the petitioner escaped from the scene. It is submitted by learned counsel for the petitioner that there was love affairs between the informant and one Sunita Kumari and the engagement was performed but subsequently the informant refused to marry for which there was some panchayati fixed at the house of this petitioner as a result the petitioner was made accused in the present case. Patna High Court Cr.Misc. No.6389 of 2015 (2) dt.18-02-2015 2/2 retracted from his initial version and filed a petition to that effect before the learned court below.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur in connection with Sakra P.S. Case No. 231 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
