2. After some argument, learned counsel for the petitioner is permitted to withdraw this application as the FIR cannot be quashed on the basis of the defence of the petitioner.

3. This application is permitted to be withdrawn with liberty to the petitioner to file an application before the Superintendent of Police, West Champaran giving out his defence and all the materials in support of his defence.

4. At this stage, learned counsel for the petitioner submits that such an application has been filed before the Superintendent of Police, West Champaran. The Superintendent of Police, West Champaran shall be obliged to consider the defence of the petitioner and the materials annexed by the

Patna High Court CR. MISC. No.55953 of 2024(2) dt.05-08-2024 2/2 petitioner before taking a final decision on the allegation levelled against the petitioner.
