JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 01-04-2015 Heard learned counsel for the petitioner as well as learned counsel for the State.

In this application for anticipatory bail the petitioner apprehends his arrest for the offences punishable under sections 304 (B) and 201/34 of the I.P.C and section 3⁄4 of the Dowry Prohibition Act.

Allegedly, the petitioner being husband of daughter of the informant due to non fulfillment of demand of dowry of Rs. 50,000/- and a colour T.V. killed her being in collusion and conspiracy with other co-accused and cremated the dead body in the night itself.

Submission is of false implication and that in this case other co-accused have been allowed pre-arrest bail. There is no

Patna High Court Cr.Misc. No.38821 of 2014 (2) dt.01-04-2015 2/2 specific allegation against the petitioner and further the case has been lodged after delay of five days, to which the learned A.P.P. opposes.

Considering that the petitioner is the husband and he being solely responsible, this Court is not persuaded to grant prearrest bail to the petitioner. Accordingly, his such prayer stands rejected in connection with Nardiganj P.S. Case No. 57 of 2011 pending in the court of C.J.M. Nawada.
