2. Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 126 (2), 115 (2), 118, 109, 352, 351(2) and 3 (5) of the BNS.
3. As per FIR, informant alleged that on 17.09.2024, when he went to inquire about flowing of water in his maize field, all the accused including these petitioners assaulted him. When brother of informant came to rescue, he was also assaulted by petitioner no.3.
4. It is submitted on behalf of the petitioners that
Patna High Court CR. MISC. No.63278 of 2025(3) dt.09-10-2025 2/2 sudden quarrel arose between the parties due to trivial issue which resulted in altercation in which both sides sustained injuries. Case and counter case. Injury, allegedly, caused by these petitioners are simple in nature. Petitioners claim clean antecedent.
5. Learned counsel for the State opposes the bail petition.
6. Considering the nature of injury, clean antecedent of these petitioners and other circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Siwan in connection with Maharajganj P.S. Case No. 428 of 2024, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023.
