The petitioner apprehends his arrest in Belaganj P.S. Case No. 40/02 registered under section 302/34 of the Indian Penal Code and 27 of the Arms Act.

Petitioner is of course not named in the first information report but name of the petitioner figured in the case during the course of investigation from the mouth of informant and others. The Investigationg Officer submitted charge sheet against accused persons.

It is submitted that the informant has sworn an affidavit that the petitioner did not take part in the murder. It appears that the case is of the year 2002 and after more than ten years the petitioner moved for anticipatory bail. There is specific allegation that the petitioner also participated in the killing.

Patna High Court Cr.Misc. No.40914 of 2014 (3) dt.01-04-2015 2/2 Hence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
