Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner, already in custody, seeks bail in connection with Shikarpur P.S. Case No.304 of 2017 registered under Section 302 of the Indian Penal Code.

Allegation in brief is that the informant's daughter, mother of the petitioner, was found killing by strangulation in her own house and it is alleged that due to previous enmity, someone had killed her, however, during investigation suspicion is raised against the petitioner, the own son, who is said to have killed his mother because of having illicit affair with a covillager.

Patna High Court Cr.Misc. No.29608 of 2018(4) dt.17-07-2018 2/2 Learned counsel for the petitioner submits that as alleged the petitioner is own son of the deceased and he has been falsely implicated in this case and there is no eye witness and the petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances, petitioner Sajjad Gaddi is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bettiah, West Champaran in connection with Shikarpur P.S. Case No.304 of 2017.
