Mr. Ajay Mishra ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-08-2019 This is an application for grant of anticipatory bail in connection with Dumariya P.S. Case No. 15 of 2016, disclosing offences under Sections 409/34 of IPC.
Prosecution story is that District Education Officer, Dumariya, Gaya has asked the Panchayat Sevak to submit the relevant folder to the appointment of Niyojit Teacher but the petitioner has not sent the folder and as such, the Block Education Officer was directed to lodge a case against him. Submission of the learned counsel for the petitioner is that he has already sent the folder but no receipt was given and as such, this case has been lodged.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner,
Patna High Court CR. MISC. No.48706 of 2019(2) dt.05-08-2019 2/2 above named, surrender before the court below by 14.08.2019, on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M., Sherghati, Gaya, in connection with Dumariya P.S. Case No. 15 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he will co-operate the I.O. and appear as and when required, otherwise, the prosecution is at liberty to move for cancellation of his bail bonds.
