JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2019 This application, for grant of anticipatory bail, arises out of Fulwaria P.S. Case No. 140/18, disclosing offences under Sections 25(1-b)a / 26 (ii) of the Arms Act. Allegation is of recovery of two live cartridges of . 315 bore cartridge from the petitioner. Apart from that petitioner is accused in five other cases.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and in fact nothing has been recovered from his possession and at the time of alleged recovery, he was admitted in Alexia hospital Begusarai.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances as well as the fact that petitioner is accused in

Patna High Court CR. MISC. No.52671 of 2019(2) dt.23-08-2019 2/2 other cases, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.

This application is, accordingly, dismissed.
