The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code. The prosecution case is that in the background of dispute with regard to making assault to the shegoat of the accused persons, who damaged the guava tree of the informant and thereafter on the order of co-accused Laxman Rai, this petitioner assaulted the informant with knife and co-accused Laxman Rai and other accused persons assaulted the informant with lathi and danda. It is further alleged that co-accused Prabandh Kumar snatched gold chain of the informant.
Patna High Court Cr.Misc. No.10537 of 2016 (2) dt.08-03-2016 2/2 It is submitted by learned counsel for the petitioner that the injury has been found to be simple in nature. Statement to that effect has been made in paragraph 10 of the petition, which reads as follows:- "That from perusal of injury report it is made clear that injury is simple in nature" and there is no accusation of repetition of blow.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Patory P.S. Case No. 413 of 2015 pending in the court of learned Chief Judicial Magistrate, Samastipur.
With the aforesaid observation, this application is disposed of.
