2. The petitioner seeks bail in a case registered for the offence under Sections 191(2), 193(3), 126(2), 109, 352 of the Bhartiya Nyaya Sanhita and Section 27 of the Arms Act. 3 . As per the prosecution case , on 31.08.2024 at about 7:45 AM, all the F.I.R. named accused persons including petitioner came near informant and on the order of co-accused Mahendra Yadav, all the accused started indiscriminate firing. It is further alleged that this petitioner, Sunil Yadav fired from his pistol, causing injury on the neck of informant.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this
Patna High Court CR. MISC. No.48918 of 2025(3) dt.31-10-2025 2/2 case due to village politics. Petitioner is in custody since 30.03.2025 .
5 . Learned A.P.P. for the State as well as informant opposed the bail petition .
6. Considering the aforesaid facts, period of custody and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda in connection with Rahui P.S. Case No. 452 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) Koushik/- U
