The petitioner has been in custody since 13.03.2018 in connection with Gardanibagh P.S. Case No. 92 of 2018 registered for the offences punishable under Section 420, 471 of the Indian Penal Code.

Learned counsel for the petitioner submits that admittedly the petitioner had failed at the written examination and therefore could not have availed the benefit of participating in the physical test. However, it is alleged in the First Information Report that on the basis of suspicious admit-card, the petitioner was trying to gain entry for participating in the physical test and, thereafter, he was taken into custody.
