JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2019 This is an application for grant of anticipatory bail in connection with Araria (Madanpur) P. S. Case No.279 of 2019, disclosing offences under Sections 341, 323, 386, 435, 427, 504, 506, 34 of the IPC.
As per F.I.R. there is allegation against the petitioner and other accused persons that they have demanded Rs.50, 000/- and for that, they set the motorcycle of the informant on fire. Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case, having no criminal antecedent.
Heard learned A.P.P. also, who opposed the prayer for anticipatory bail of the petitioner.
Having heard both sides, in view of the allegation, I
Patna High Court CR. MISC. No.46635 of 2019(4) dt.20-12-2019 2/2 am not inclined to grant privilege of anticipatory bail to the petitioner. However, if he surrenders before the learned court below and make prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by this order.
