1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Siwan Mufassil (Mahadeva) Police Station Case No. 207 of 2025, dated 23.03.2025, disclosing offences punishable under Sections 25(1-B)(a)/26/35 of the Arms Act.

The prosecution case, as per the First Information Report, is that the police arrested one Satish Kumar in connection with Mahadeva Police Station Case No. 206 of 2025, lodged in connection with the murder of one Sanjay Kumar Sah and raided the house of Satish Kumar and recovered one pistol and one motorcycle used in the murder of Sanjay Kumar Sah.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has not committed any offence in the manner alleged. He further submits that no incriminating material has been recovered from the premises belonging to the petitioner. He next submits that the name of the petitioner transpired in the confessional statement of co-accused Satish Kumar, who was arrested in connection with Mahadeva Police Station Case No. 206 of 2025, and co-accused Satish Kumar has not only confessed his guilt, but has also disclosed the name of the petitioner as the person who fired upon Sanjay Kumar Sah, leading to his death at the spot.
5. I have heard learned Counsel for the parties concerned and have perused the material available on record, including the impugned order.
6. From perusal of the impugned order, it transpires that the co-accused Satish Kumar, in his confessional statement, has disclosed the active involvement of the petitioner in the alleged offence.
7. Considering the above, I do not find any reason to differ with the findings arrived at by the learned Additional Sessions Judge-X, Siwan, inasmuch as the case is under
Patna High Court CR. MISC. No.48885 of 2025(2) dt.11-08-2025 3/3 investigation, wherein the custodial interrogation of the petitioner may be necessary based upon the material collected by the police during course of investigation. As such, I am not inclined to grant anticipatory bail to the petitioner.
