====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 17-03-2021 Heard the parties.
The petitioner is languishing in custody for the offence punishable under Sections 323, 363, 364, 365, 366A and 504 of the Indian Penal Code.
Considering the nature of allegation against the petitioner that he ravished to a minor girl, in the past prayer for bail was refused on 16.03.2020 vide order at Annexure-1. The trial Court was directed to expedite the trial. The report of the trial Judge dated 12.03.2021 reveals that the case is fixed on 26.03.2021 for framing of the charges. Evidently due to COVID effect, the trial was stagnant. Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail for the present in connection with Sahebganj P.S. Case No. 289 of
Patna High Court CR. MISC. No.7058 of 2021(3) dt.17-03-2021 2/2 2018.
Hence, prayer is refused.
Learned trial Judge is directed to conclude the trial within nine months. No unnecessary adjournment shall be allowed by the trial Judge.
