2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code.

3. As per the prosecution case, informant suspects that all the named accused persons including this petitioner, with whom the deceased had previous enmity, killed the son of the informant.

4. Learned counsel for the petitioner submits that informant is not an eye witness of the occurrence. Only suspicion has been raised against this petitioner, on account of previous dispute with the deceased. During trial, the informant has turned hostile. Petitioner claims clean antecedent

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of District and Additional Sessions Judge-XII, Saran at Chapra in connection with Baniyapur P.
