Mr.A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 420, 468 and other allied sections of Indian Penal Code.
As per prosecution case, petitioner is only alleged to have threatened and ousted the informant and there is no allegation against him of taking any money from the informant. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Admittedly, as per FIR it is clear that all the affairs of the company was being managed by Pintu Rai who happened to be the proprietor of the firm in question and petitioner was
Patna High Court CR. MISC. No.50429 of 2022(2) dt.15-12-2022 2/2 simply a staff and he was not custodian of the amount paid nor had received any money from the informant.
Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XI, Bhagalpur in Kotwali (Adampur) P. S. Case No. 284 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
