JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-02-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Jaynagar P.S. Case No. 02 of 2014 registered for the offence under Sections-307, 379 & other minor sections of the Indian Penal Code.

Taking into consideration the accusation, levelled against the petitioners as well as nature of injury, sustained by the informant, I do not think it proper to extend the privilege of anticipatory bail to the petitioners and accordingly, prayer for anticipatory bail of the petitioners in connection with Jaynagar P.S. Case No. 02 of 2014 stands rejected.

No.34068 of 2014 (2) dt.12-02-2015 2/2 However, if, the petitioners surrender in the court below within four weeks from today and seeks regular bail, this order shall not cause any prejudice to the learned court below at the time of consideration of regular bail application of the petitioners.
