JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 21-12-2021 Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month.

The petitioner apprehends his arrest in connection with Manjhi P.S. Case No. 66 of 2020 registered for offence punishable under sections 341, 323, 324, 307, 354, 506/34 of the Indian Penal Code.

The informant, Vinay Kumar Singh has lodged an FIR stating therein that in the morning of the occurrence, at about 6:00 A.M., when his wife Rekha Devi with his mother Naina Devi was going to make ease herself, co-accused Niraj Kumar

Patna High Court CR. MISC. No.6096 of 2021(3) dt.21-12-2021 2/3 Singh and Ravi Kumar Singh forcibly threw her on the ground and attempted to commit some illegal act upon her. When she raised hue and cry, the family member of the informant reached there and thereafter they went to the house of the accused persons to complain whereupon the nine accused persons named in the FIR including the present petitioner badly assaulted the informant and his family members. The allegation against the petitioner is that he inflicted rod blow on the head of Krishna Singh, who sustaining injury became unconscious. The learned counsel for the petitioner has submitted that there was previous dispute between both the parties and the co-accused Ravi Kumar Singh has also lodged Manjhi P.S. Case No. 75 of 2020 against the informant's side.

On the other hand, the learned Additional Public Prosecutor has opposed the prayer for bail.

The allegation against the petitioner is that he inflicted rod blow on the head of Krishna Singh and the injury report of Krishna Singh shows pain head back side and also pain on right knee joint, but after perusal of the C.T. Scan report, the doctor found the nature of injury is grievous.

As such, I do not think it a fit case for anticipatory bail and accordingly the prayer for anticipatory bail is rejected.

Patna High Court CR. MISC. No.6096 of 2021(3) dt.21-12-2021 3/3 Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
