JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-05-2022 Heard learned advocate for the petitioner and learned Additional Public Prosecutor representing the State. The petitioner seeks bail in connection with Kanti P.S. Case No. 491 of 2021 dated 29.07.2021 instituted for the offences under Sections 272/273/120-B of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

The petitioner is the driver of the vehicle from where 4843.800 liters of liquor has been recovered. It has been submitted on behalf of the petitioner that he had no idea about the consignment as he was an employee of his master and under his dictates, he had taken the vehicle to reach the consignment at the known destination. Be that as it may, regard being had to the period of

No.59906 of 2021(2) dt.24-05-2022 2/2 custody of the petitioner which is from 30.07.2021 and taking into account that he does not have criminal antecedents, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Muzaffarpur, Bihar in connection with Kanti P.S. Case No. 491 of 2021.
