Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
The petitioner seeks anticipatory bail in connection with Bihpur P.S. Case No. 284 of 2019, registered for the offence under Sections 147, 148, 149, 307 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is alleged to have assaulted at the head of injured namely Putul Singh by means of axe but there is no allegation of repeated assaulting and on the head of said injured only one
Patna High Court CR. MISC. No.60469 of 2021(2) dt.06-06-2022 2/2 injury has been found which has been opined simple in nature. There is case and counter case in between the parties and the present case is counter blast of Bihpur P.S. Case No. 283 of 2019 and the petitioner has no criminal antecedent. Considering the aforesaid facts, this application for anticipatory bail is allowed.
Let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st Naugachia, Bhagalpur in connection with Bihpur P.S.
