JUSTICE SUDHIR SINGH ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 21-03-2017 From the Counter Affidavit filed by the respondents, it is seen that instructions have been issued by the Government in the Department of Health vide Memo dated 05.11.2014 (Annexure 'A') to various Principals / Superintendents of Government Medical Colleges and Hospitals, Civil Surgeons and other authorities in the matter of complying with various provisions for purchase of medicines and other supplies to the hospitals.

Now as the guidelines are already available and fresh guidelines have been issued on 15.02.2017, as is evident from Paras 6, 9 and 12 of the Counter Affidavit, no further indulgence into the matter is called for. In case of any violation of the aforesaid guidelines

Patna High Court CWJC No.3317 of 2016 dt.21-03-2017 2/2 and rules, the petitioner may point out specific instances and challenge the same in appropriate proceedings in accordance with law. For the present, in the light of the guidelines as indicated above, no further action is called for. However, for knowledge of all concerned, the respondents are directed to ensure that the guidelines and the system put in place for purchase of medicines, other supplies to the hospitals and demand are uploaded on the Website for knowledge of all concerned, if not already done. The petition is disposed of.
