The petitioner apprehends his arrest in Chanpatia (Sirisiya O.P.) P.S. Case No.78 of 2019 registered under Sections 467, 468, 414 of the Indian Penal Code and under Sections 30(a), 30(b) and 30(c) of the Bihar Prohibition and Excise Act.
On secret information, the informant raided the place and arrested Rajesh Kumar, Bullet Kumar and Hira Ram and from their possession, country made liquor was recovered. Bullet Kumar is said to have disclosed the name of petitioner and alleged that he used to sell liquor at the brick kiln of Munna Mahto (petitioner), but nothing has been recovered from possession of the petitioner. Save and except disclosure made by Bullet Kumar, there is no material against the petitioner. The

Having considered the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran in connection with Chanpatia (Sirisiya O.P.) P.S. Case No.78 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Harish/- U T
