The petitioner seeks regular bail in connection with Sachivalaya P.S. Case No. 40 of 2019, registered for the offence punishable under Section 392 of the Indian Penal Code.

The allegation is regarding unknown accused persons having snatched a sum of Rs. 1,70,000/- from the informant and thereafter, the said accused persons are said to be fled away. The learned counsel for the petitioner submits that the F.I.R. is against unknown accused persons, no Test Identification Parade has been held so as to implicate the petitioner in the alleged crime and moreover, no recovery of any sum of money has been made from the possession of the

It is further submitted that the petitioner is an accused in one another case and from the said case, the petitioner has been remanded in the present case and he has been falsely implicated in the present case. It is further submitted that in the said criminal case, the petitioner has been granted bail. The petitioner is languishing in custody since 16.5.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge II cum Additional Chief Judicial Magistrate Patna in connection with Sachivalaya P.S. Case No. 40 of 2019.
