At this juncture, this Court is not giving any direction as has been stated by the State that the enquiry proceeding is going on but, the petitioner is not participating in the same and, on that account, the proceeding has not been completed, submitting that the entire payment will be made subject to final result of the departmental proceeding.

In view of the above, the petitioner is directed to cooperate in the early disposal of the enquiry proceeding which

Accordingly, the petitioner is directed to appear before the Enquiry Officer who will conduct the enquiry on dayto-day basis and conclude the same expeditiously preferably within a period of two months from the date of appearance, will submit the enquiry report accordingly, in turn, within one month thereafter, the Disciplinary Authority cum Appointing Authority will take a decision in accordance with law.

Any payment made to the petitioner will be subject to the final result of the enquiry proceeding.

With the aforementioned observation, this contempt petition is disposed of.
