Petitioner apprehends his arrest in connection with Sadar P. S. case no. 370/2012 registered under sections 436, 386 and 504 of the IPC.

According to the prosecution case itself, tractor of the informant was put on fire by the petitioner and, therefore, application of section 436 of the IPC appears to be doubtful. So far as demand of extortion money is concerned, according to the prosecution case itself, aforesaid demand was not made directly by the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let

Patna High Court Cr.Misc. No.5426 of 2015 (2) dt.10-02-2015 the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in Sadar P. S. case no. 370/2012 subject to condition as laid down under section 438(2) of the Cr.P.C.
