Petitioner seeks regular bail in a case registered for the offence punishable under Section 498, 304B/120(B) of the Indian Penal Code .

As per the prosecution case, this petitioner along with his family members committed torture and caused death of the daughter of informant for demand of dowry.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The marriage was solemnized in the year 2004 and out of the wedlock five children were borne which itself suggests that relation between the husband and wife was cordial. It is next

Patna High Court CR. MISC. No.60470 of 2021(3) dt.25-03-2022 2/2 submitted that deceased died on 03.06.2017 but the complaint petition was lodged on 18.12.2018, that is after 18 months of the occurrence, without any explanation for such delay. Petitioner, who is husband of the deceased, is in custody since 12.08.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the delayed lodging of the complaint, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Katihar in connection with Katihar Muffasil PS case No.81/2019.
