2. The petitioners apprehend their arrest in connection with Hathauri P.S. Case No. 64 of 2023, registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504 and 34 of the IPC.

3. In the backdrop of putting a Tat, the dispute arose between the parties and in consequence thereof the petitioners are said to have inflicted with Mattock on the head of the informant as a result of which, injury was sustained.

4. The learned counsel for the petitioners has submitted that the petitioners are the persons of clean antecedents. They have falsely been implicated in this case. He has also submitted that

Patna High Court CR. MISC. No.50747 of 2023(4) dt.13-12-2023 2/2 there is allegation against the petitioner no. 1 that he assaulted on the head of the informant with an axe, but the injuries are simple in nature.

5. On the other hand, Sri Shailendra Kumar, learned APP for the State has opposed the prayer for bail and submitted that the petitioner no. 1 inflicted repeated blow on the head of the informant.

Considering the above-mentioned facts and circumstances, especially the clean antecedent as well as the nature of injury, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sri. Amit Kumar Pandey, Judicial Magistrate-Ist Class, Rosera in connection with Hathauri P.S. Case No. 64 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.
