2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

3. The allegation in the first information report is that the Aadhar card, ATM card, PAN card, key of the shop, mobile and some other documents which were kept in the dicky of the motorcycle got stolen when the informant had gone to meet with local Mukhiya after parking his motorcycle in front of his gate.

4. It is submitted by learned senior counsel for the petitioner that the first information report has been lodged

No.60579 of 2024(4) dt.07-05-2025 2/3 against the unknown and during course of investigation one co-accused, Raushan Kumar was apprehended from whom the stolen mobile was recovered. The name of the petitioner has surfaced in this case on the confessional statement of co-accused, Raushan Kumar, who has already been granted regular bail vide order dated 04.03.2021 passed in Cr. Misc. No.1398 of 2021. Except the confessional statement of the co-accused, there is no other material against the petitioner to connect to the alleged offence. No recovery has been made from his physical or conscious possession.

5. Learned APP for the State opposed the prayer for bail on the ground of allegation made in the first information report.

6. Having regard to the facts and circumstances of the case as well as the fact that petitioner has no criminal antecedent and nothing has been recovered from his conscious or physical possession, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below
