The petitioner seeks regular bail in connection with Kothi P.S. Case No. 31/2017 for the offences punishable under Sections 341, 323, 427, 435, 387, 504, 506, 120(8) of Indian Penal Code and Section 27 of Arms Act.
The allegation is regarding three unknown persons having assaulted the employees of the construction company, while they were constructing the road and had thereafter opened fire. It is further alleged that the said incident had occurred on account of employees of the construction company having not fulfilled the demand of Lallu Bhaiya. It is further alleged that the said accused person sprinkled petrol upon JCB machine and set it on fire.

No.31777 of 2018 (2) dt.31-05-2018 2/2 The learned counsel for the petitioner submits that the petitioner is a non FIR named accused person and his name had transpired in the confessional statement of said Lalu Bhaiya. It is further submitted that similarly situated a co-accused person has been granted bail by this Court vide order dated 09.05.2018 passed in Cr. Misc. No. 21415 of 2018. The petitioner is stated to be having a clean antecedent and is languishing in custody since 30.01.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Kothi P.S. Case No. 31/2017.
