2. The petitioner is apprehending her arrest in connection with Patahi P.S. Case No. 157 of 2024 dated 23.06.2024 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code
3. As per the prosecution case, the petitioners along with the other co-accused persons are alleged to have assaulted the informant and his family members.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather the allegation against the petitioner is general and
Patna High Court CR. MISC. No.50177 of 2026(2) dt.29-07-2026 2/3 omnibus in nature. It has further been submitted that there is admitted land dispute between the parties. It has further been submitted that there is a case and counter case between the parties and both sides have sustained injuries. It has further been submitted that the co-accused persons namely, Ajay Singh @ Ajay Kumar Singh, Amit Kumar Singh, Ravi Ranjan Singh @ Ravi Ranjan Kumar @ Runjhun Singh and Tuntun Pandey @ Tuntun Kumar Pandey have been extended the privilege of anticipatory bail by a Co-ordinate Bench of this Court by order dated 23.10.2024 passed in Cr. Misc. No. 71146 of 2024 and the co-accused, Amrendra Singh has also been extended the privilege of anticipatory bail by a Co-ordinate Bench of this Court by order dated 20.08.2025 passed in Cr. Misc. No. 34505 of 2025. It has further been submitted referring to the impugned order that the investigation against the petitioner is still under progress. It has lastly been submitted that the petitioner, who is a lady, has got no criminal antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.
6. Heard the learned counsel for the parties and perused the record.
7. Considering the facts and circumstances of the case
Patna High Court CR. MISC. No.50177 of 2026(2) dt.29-07-2026 3/3 as well as the parity, let the above named petitioner, in the event of her arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Judicial Magistrate-1st, Motihari, East Champaran in connection with Patahi P.S. Case No. 157 of 2024, subject to conditions as laid down under section 438(2) of the Cr.P.C.
8. The application stands allowed.
