The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 376/511, 354B of the Indian Penal Code 8 of The Protection of Children from Sexual Offences Act, 2012. The prosecution case is that the petitioner made an attempt to ravish the informant.
It is submitted by learned counsel for the petitioner that with exaggerated accusation the FIR was lodged. No medical examination of the informant was done and the informant subsequently retracted from the initial version and filed a petition to that effect before the learned court below.
Patna High Court Cr.Misc. No.9261 of 2016 (2) dt.29-02-2016 2/2 A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Supaul Mahila P.S. Case No. 87 of 2015 pending in the court of learned Additional Sessions Judge 1st, Supaul.
With the aforesaid observation, this application is disposed of.
