JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-07-2019 This application, for grant of anticipatory bail, arises out of Sabour P.S. Case No. 359/18, disclosing offences under Sections 147, 148, 341, 323, 324, 325, 307 and 302 of the Indian Penal Code.

Allegation as per F.I.R is that petitioner dragged the informant and confined him in a room, where petitioner and others brutally assaulted him and left him and later on the informant died.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and it is not possible for one person to drag the informant outside the house and in fact the deceased received injuries at some other place and in some other place.

No.46455 of 2019(2) dt.26-07-2019 2/2 Learned counsel for the State opposed the prayer for grant of anticipatory bail and submitted that witnesses during the investigation has stated that they saw Bambam Mandal (deceased) in injured condition and he has disclosed the name of accused persons.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner. This application is, accordingly, dismissed (Vinod Kumar Sinha, J) sunilkumar/- U T
