Petitioner seeks bail in Bypass P.S. Case No. 300 of 2019 registered for the offence punishable under Sections 302, 506 and 120(B)/34 of the Indian Penal Code.

Allegation against the petitioner is of killing the son of the Informant by firing.

Learned counsel for the petitioner submits that he is innocent and has been falsely implicated in this case. It is further submitted that petitioner and his family members have been made accused due to political rivalry. Petitioner has got no criminal antecedent and is in custody since 20.11.2019. Considering the fact that there is direct allegation

Patna High Court CR. MISC. No.5837 of 2021(4) dt.15-07-2021 2/2 against the petitioner of firing upon the son of the Informant as a result of which he died, which is corroborated by post mortem report, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.

However, trial court is directed to expedite and conclude the trial within one year from the date of receipt/production of a copy of order passed by this Court.
