Criminal Miscellaneous No.6838 of 2015 Arising Out of PS.Case No. -175 Year- 2012 Thana -BAHERI District- DARBHANGA ======================================================

1. Puttu Kr. Lal Deo @ Puttu Lal Deo S/O Mahesh Lal Deo, resident of Village- Turki, P.S. Baheri, District- Darbhanga .... .... Petitioner/s

Versus

1. The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Dharmendra Jha For the Opposite Party/s : Mr. Rajiv Nayan(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 06-07-2015 Heard the Counsel for the petitioner and the APP for the State.

Petitioner is said to have inflicted knife injury on the neck. Another accused is said to have assaulted the informant with farsa on his head. The petitioner along with another are, therefore, facing accusations punishable under Section 307 and other allied sections of the Indian Penal Code. He seeks anticipatory bail. Contention of the petitioner is that the injury sustained by the informant near the neck was simple. The cause of occurrence is land dispute. The petitioner has no criminal antecedent. The learned Sessions Judge in the impugned order has noticed that the injury on the neck was found caused by sharp cutting weapons which supports the allegation.

Patna High Court Cr.Misc. No.6838 of 2015 (3) dt.06-07-2015 2/2 In my view, it is not a fit case where the petitioner can be privileged with anticipatory bail. Prayer is, accordingly, declined. Let the petitioner surrender and seek regular bail. (Kishore Kumar Mandal, J) Pankaj/- U T
