JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419,420 and 414 of the Indian Penal Code.
The prosecution case is that on the information that co accused Madhusudan Yadav used to cheat public by giving fake advertisement in the newspaper as well as through mobile phone, raid was laid when Madhusudan yadav was apprehended while talking on phone who admitted the act of cheating and from him several mobile numbers were recovered. The name of petitioner came in the confessional statement of Madhusudan Yadav. It is submitted by the learned counsel for the petitioner that thrust of accusation is against co accused Madhusudan yadav
Patna High Court Cr.Misc. No.8758 of 2016 (2) dt.24-02-2016 2/2 and except confessional statement nothing transpired against the petitioner during investigation. More over, similarly situated accused have been granted anticipatory bail vide Cr. Misc. Nos. 40217 of 2013 and 7839 of 2014. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nawada in connection with Kashichak (Shahpur OP) P.S. Case No.8 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
