JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-07-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 7.11.2017 passed in Cr.Misc.No.45624 of 2017.
Submission of learned counsel for the petitioner is that petitioner has been made accused on the basis of confessional statement of co-accused and CDR location and petitioner is in custody for the last one and a half years and till date no substantive progress has been made in trial.
Heard learned APP and from perusal of report it appears that petitioner has been made accused in 12 other cases and three witnesses have been examined and process has been issued for remaining witnesses and learned trial court has assured that trial will be concluded within three months.
Patna High Court Cr.Misc. No.31208 of 2018 (3) dt.04-07-2018 2/2 Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial and conclude it within a period of three months from the receipt of this order. At the same time, Superintendent of Police, Sitamarhi is directed to see that witnesses are present in court so that trial may be concluded within the said period.
