====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 19-07-2018 Heard learned counsels for the petitioner and the State as well as learned counsel for the informant.
The petitioner, already in custody, seeks bail in connection with Bettiah (Town) P.S.Case No. 866 of 2017 registered under Section 365 of the Indian penal Code. Allegation in brief is that informant's brother went to Bettiah and thereafter did not return back. It is alleged that someone had kidnapped him.
Submission is that FIR is against unknown and the petitioner is maternal cousin of the deceased. It is alleged that deceased was acting as a middle-man in land deal, therefore, having conspired, the petitioner got him eliminated but there is
Patna High Court Cr.Misc. No.31177 of 2018(4) dt.19-07-2018 2/2 no any material in the case diary to substantiate such allegation. Learned counsel for the informant opposed the prayer of bail.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Chandan Kumar @ Chandan @ Chandan Singh, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned C.J.M., West Champaran at Bettiah in connection with Bettiah (Town) P.S. Case No. 866 of 2017.
