The petitioner is in custody in connection with Khagaria (Muffasil) P.S.Case No.670 of 2017 registered for an offence under Sections 341, 323, 427, 504 and 307/34 of the IPC and section 27 of the Arms Act.

As per written report of the informant, the allegation is that this petitioner along with five or six unknown armed with lathi came at his shop and damaged his articles. This petitioner shot fire causing abrasion injuries on the chest. It has been submitted that the occurrence took place in the evening of 30th September, 2017. He was treated by the doctor. The doctor has not mentioned the time and date of his treatment. The injury report which is annexed to this application shows that the informant sustained simple injury. He further submits that the

Patna High Court Cr.Misc. No.30010 of 2018 (3) dt.02-07-2018 2/2 matter has been compromised. In support of compromise, the certified copy of the compromise petition was produced at the time of hearing of the bail petition. The petitioner is in custody since 09.04.2018 having clean antecedent.

The learned APP opposed the submissions.

Considering the aforesaid facts and circumstances, prayer for bail is allowed. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Khagaria in connection with Khagaria (Muffasil) P.S.Case No.670 of 2017 with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
