2. This is the first bail application for grant of anticipatory bail of the petitioner apprehending his arrest in connection with Kankarbagh P.S. Case No. 301 of 2025 registered for the offence under Sections 126(2), 115(2), 109, 74, 352, 351(2) and 3(5) of the of the Bharatiya Nyaya Sanhita.
3. The present applicant and the complainant/injured person Ravi Ranjan are the real brothers. According to the case of prosecution, on 08.04.2025 at about 08.30 A.M., it is alleged that the present applicant as well as other co-accused persons assaulted the Ravi Ranjan, his wife and daughter with the help of wooden stick, due to which, Ravi
Patna High Court CR. MISC. No.50124 of 2025(2) dt.11-08-2025 2/3 Ranjan sustained injuries on his head. He was taken to the hospital and after treatment, he was discharged from the hospital. The first information report has been lodged by the wife of Ravi Ranjan, on the basis of which, the offence has been registered against the present applicant and other co-accused persons.
4. It is submitted by the learned counsel for the petitioner that petitioner is innocent and has falsely been implicated in the present case. There is dispute in between both the family members due to some water, therefore, on the date of incident also the complainant party came to the present applicant and they firstly assaulted the applicant and his family members due to that they also sustained injuries. He further submits that counter case has also been lodged by the applicant and his family members. Lastly, he submits that the injury sustained by Ravi Ranjan are of simple in nature. The other coaccused persons namely, Ayush Ranjan @ Adarsh and Piyush Ranjan Srivastava @ Harsh have already been granted anticipatory bail by the Trial Court itself. Therefore, on these grounds, it is prayed that the petitioner applicant may also be granted benefit of anticipatory bail.

7. Perused the records and other materials available on record.
8. Considering the submissions made by the counsel for the petitioner and further considering the fact that all the other co-accused persons have already been granted benefit of anticipatory bail and further taking into consideration the fact that the injured Ravi Ranjan has sustained injuries of simple in nature only, I am of the view that it is a case where the petitioner should be granted benefit of anticipatory bail.
9. Accordingly, the application is allowed.

Let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-XI, Patna in connection with Kankarbagh P.S. Case No. 301 of 2025, subject to the condition as laid down under Section 482(2) of B.N.S.S. 2023.
