The petitioner seeks regular bail in connection with Bihta P.S. Case No.125 of 2018 for the offences punishable under Section(s) 30(a) of the Bihar Prohibition of Liquor and Excise Act, 2016..

The allegation is regarding the recovery of 150 liters of illicit liquor from the open field.

The learned counsel for the petitioner submits that neither any recovery has been made from the conscious possession of the petitioner nor the place from where the said illicit liquor has been recovered belongs to the petitioner. It is further submitted that the petitioner has a clean antecedent and is languishing in custody since 08.02.2018.

Having regard to the facts and circumstances of the case, the

Patna High Court Cr.Misc. No.32026 of 2018 (2) dt.24-05-2018 2/2 petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Bihta P.S. Case No. 125 of 2018.
