2. The petitioners are apprehending their arrest in a case in connection with Patahi P.S. Case No. 113 of 2026 dated 17.04.2026 registered for the offences punishable under Sections 190, 191, 192, 303(2), 126(2), 115(2), 117(2), 109(1), 351(2), 352 and 3(5) of the B.N.S.
3. As per the allegation, when the informant reached at his field, he saw the accused persons including the petitioners
Patna High Court CR. MISC. No.50302 of 2026(2) dt.29-07-2026 2/3 present there and as soon as they saw the informant, co-accused Sunil Singh inflicted Farsa blow on his father and looted his crops. When the informant went to protect his father, he too was attacked. It has further been alleged that one of the relatives of the informant namely, Dharmendra Kumar Singh was also attacked by the petitioners and other co-accused persons. Thereafter, help of Police was taken by making a call on Dial 112, when the Police reached at the place of occurrence, they took the informant and his father to the nearby Primary Health Centre for their treatment from where the informant's father was referred to Sadar Hospital, Motihari.
4. Learned counsel for the petitioners has submitted that there is general and omnibus allegation against the petitioners, the specific allegation is against co-accused, Sunil Singh. It has further been submitted that due to enemical persons of the locality, the petitioners have been made accused in this case. It has further been submitted that the allegation is of assault by as many as 12 named accused persons, including the present petitioners, along with 50 unknown persons but the same is not corroborated by the injury report of the injured persons. Lastly, it has been submitted that petitioners have got no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioners.
6. Heard the learned counsel for the parties and perused the record.
7. Considering the facts and circumstances of the case, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, I, East Champaran at Motihari, in connection with Patahi P.S. Case No. 113 of 2026 subject to conditions as laid down under section 482(2) of the B.N.S.S.
8. The application stands allowed.
