Petitioner, already in custody, seeks bail in connection with Pupri PS Case No.228 of 2017, registered under Sections 406, 409 and 420 of the Indian Penal Code as well as under Section 7 of the E.C. Act.
Allegation in brief is that the petitioner being Chairman of the concerned PACS did not deposit CMR of 305.2 quintals of paddy and the amount equivalent to the paddy was misappropriated.
Learned counsel for the petitioner submits that the petitioner has deposited the amount equivalent to the price of paddy and Bank has also given No Dues Certificate subsequently vide
Patna High Court Cr.Misc. No.30571 of 2018(2) dt.17-05-2018 2/2 Annexure-2 and the learned counsel appearing on behalf of the Bank also admits that now there is no due.
Having considered the aforesaid facts and circumstances, petitioner Amiri Rai is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Pupri at Sitamarhi in connection with Pupri PS Case No.228 of 2017.
