JUSTICE SANDEEP KUMAR ORAL ORDER 04-12-2023 This is an application for direction to the respondent to pay Rs. 84,465/- to the petitioner with interest for the work of supply of water.

2. Learned counsel for the State has submitted that the Executive Engineer, Public Health and Engineering Deptt, Buxar (respondent no. 6) is the authority who can release the payment.

3. The petitioner is given liberty to approach the respondent no. 6 and file a representation before the Executive

Patna High Court CWJC No.11359 of 2023(2) dt.04-12-2023 2/2 Engineer, Public Health and Engineering Department, Buxar (respondent no. 6) within one month.

4. If the Executive Engineer, Public Health and Engineering Department, Buxar (respondent no. 6) finds merit in the claim of the petitioner then the amount must be paid to the petitioner within another 15 days from the disposal of the representation.

5. The Executive Engineer, Public Health and Engineering Department, Buxar (respondent no. 6) will also consider the fact that payment of interest on the delayed payment to the petitioner in accordance with law and in accordance with guide lines of the State in this regard.

6. With the aforesaid observation and direction, this application is allowed.
