2. The petitioner is in custody in connection with Banka P.S. Case No. 348 of 2019 (S.T. No. 265 of 2024) for the offence under Sections 324, 302/34 of the Indian Penal Code lodged on 29.05.2019 by the informant, Rizwani Khatoon.

3. As per the prosecution story, the informant alleged that her nephew (8 years old) came and informed that his mother is being assaulted by this petitioner as also the wife due to quarrel regarding the goat and the allegation is that this petitioner gave several knife blows to the lady. She was unconscious, rushed to the Sadar Hospital, Banka but was declared dead. Accordingly, the FIR.

4. It is the case of the petitioner that both are family

Patna High Court CR. MISC. No.53254 of 2024(3) dt.23-10-2024 2/2 members and due to quarrel regarding keeping the goat inside the house, scuffle took place and she sustained injuries and ultimately, succumbed to it.

5. Learned APP has pointed out that 8 years old son of the deceased informed the informant about the repeated knife blows given by the petitioner to his mother, the informant rushed to the place and found her in an unconscious condition with unlimited knife blow on the body. Though she was rushed to the Hospital, unfortunately, succumbed to the injuries.

6. The petitioner is the main assailant in the case. The case is of the year 2019 but he came into the judicial custody four years later in the year 2023.

7. The trial is on, it would be appropriate that he faces it and no case for bail is made out.
